Who know what DEFAULT AMNESTY process? I get a communication? from a creditor about a debt that my ex and i owe.

from a creditor about a debt that my ex and i owe. our divorce rule says we're respectively 50% liable for this debt. I wrote to the co. 6 mos ago explaining that they need to contact my ex also. I can't enjoy any contact with my ex because of treat roughly, and restraining orders against him contained by the past. so very soon I get a note saying they will modify my tale in a method that will Greatly Reduce the obligation. they own a Default Amnesty program to set up payments. I don't like the nouns of this because i don't understand it. as far as i can see, they will lone forgive interest and penalties. I don't reckon they have even tried to collect from my ex, and i can't afford to draw from stuck paying for this thing by myself. It's almost $5,000.!

I can't answer in need some additional info, such as state you live surrounded by, and how old the debt is.

The previous answer is not slightly accurate. You have a court establish demanding that the spouse pay partially of the debt. Depending on the state you are in, near isn't much the creditor can do about that.

What they are doing is trying to wish who they have the best kismet of collecting from (that sounds like you) and they are going to give an account you any lie they can come up next to to prompt you to pay (default amnesty, anything the heck that is).

You need to look at the correlation below and understand the statute of reduction laws, and why it's vital that you be carefull before you income them anything. If you make one expenditure, it will extend the legal time they own to sue you for the debt.

Try this idea (pass it by your divorce attorney first). Send the creditor a copy of the court command saying you lone are responsible for half the debt. You influence it's $5000.so you are admitting to owing $2500. Make them an submission of $1500 in installment payments. In exchange, they agree to sanction the court order and will pursue the partner from your spouse. They also agree to the payment expressions you propose, plus agree to not pass show your portion of this bill as "remunerated in full". Otherwise they may go past the remaining balance on to another collection agency, who will hound you some more.

Also constraint that any negative information on the subject of this debt be removed from your credit report.

In the meantime, you could see why your attorney is not pursuing the spouse to fulfill his portion of your divorce order.
Ouch.

You see, they don't assistance who pays it and your divorce decree have nothing to do next to them.

You both are liable in their eyes and they don't precision where the money comes from - they in recent times want the money.

You would need to sue your ex if you stop up paying the whole item. However, you can not force them to contact her for partial payment. You are liable for the integral amount, as is she.
