Is this re-aging a debt? I have my EQ report and it says... Date open: 6/2004 Date reported: 10/2006 Date
Date open: 6/2004
Date reported: 10/2006
Date of last payment: 10/2006
Date Major Delinquency first reported: 4/2006
charge sour amount: xxxx
Date of first deliquency: 9/2005
my question is...I know I never made a payment on 10/2006
but it's noted as such..
is this a re-aging of the information?
ps...no smart a$$ answers...I know it's my debt..just wondering if someone is trying to re-age it or they already re-aged it
if it is..how do I dispute it with the CRA...as approximate tradeline? thanx
Answers: Reaging is changing the date of first delinquency to keep the date down on your credit report longer.
Showing these "phantom" payments can reset the statue of limitations on the debt though, so it's something you should challenge and demand proof of.
Just dispute it as "no wage made in 10/2006 - please delete" and see what happens.
Edit - Yes reaging is a sacrilege. $1000 plus any damages and legal fees.
I have met the similiar problem up to that time -- still a little bit annoy, here is a good resource that relieve me out. http://debt-relief.expertips4u.info/card...
First, it is my understanding that the clock starts running near the delinquency, in this case 9/2005. That's when the seven years starts from. Activity on a delinquent portrayal after that doesn't change anything. It is only reaging if they try to adaptation the delinquency date.
Second, the penalty for getting caught reaging is: they have to fix the diary. You don't get any money.
Sometimes debt collectors will post bogus payments on your credit file to reset the statue of limitations. If this statement is with a debt collection agency (or even with the untested creditor), send them (and the credit bureaus) a letter via certified letters with return receipt stating:
I did not product this alleged payment noted on 10-2006. Per the Fair Credit Reporting Act, I am requesting validation of this payment. Please provide any of the following for validation:
* photocopy of the check
* the name of the bank and the tale # of the check that you received payment from First of all, do as Slimick says, dispatch the creditor a letter requesting proof that a payment be made on 10/2006. If they have no proof then they enjoy violated the law as per the following:
RE-DATING OF THE DEBT IN VIOLATION OF
[CITE: 15USC1681s-2] ¡ì 623. Responsibilities of furnishers of information to consumer reporting agencies
