HELP! Disputing a visa purchase through B of A? I purchased a $1600 dining room set on Sat. They only


I purchased a $1600 dining room set on Sat. They only have 4 of the 6 chairs so we opted to payment $100 for delivery on Mon. or Tues. according to merchant. We contracted that day that we changed our minds... so Sunday we call him back to right to be heard cancel our directive. he said he already had it "on the truck set for delivery Monday. Otherwise we would enjoy to pay 25% re-stocking allowance or take a store credit. He call us Tues. to say it would be here Wed. which changed to Thursday and today we received even so another call adage due to weather (grey skies!) he wouldn't be able to deliver it til' Fri! We call Bof A where they are refund the $$ tonight. We let the merchant know and he said he will be suing us blah blah blah. I want to know if near is anyway that we will be liable for any fees (re-stocking fee etc.) within this situation. Am I protected? Is he in the wrong or am I? PLEASE just people who know for sure contribute me your input and firsthand knowledge:)

Answers:    He have every legal right to sue you, but that doesn't tight-fisted that he will WIN. Here is the issue. You CAN cancel the decree, but he said that you would be required to pay a 25% restocking charge because he "already had it on the truck Monday." But if he didn't deliver till Friday, how be it still on the truck? Was the truck put out of commission making no deliveries for Monday, Tuesday, Wednesday, and Thursday? I doubt it. It wasn't on that truck, he lately doesn't want to lose the sale. Stick to your guns and uphold the stop grant. He'll lose. People will make lots of claims when they attain mad, but when it really comes down to it, it is not a smart business edict to put money into a lawsuit for a measly $1600 when he has the possibility of losing. Then he would be contained by the negative for his legal representative fees, too. Let him blow his steam and ignore him.

You are not wrong. Since it be never delivered to you and he claimed it be sitting in a truck for 4 days, he would be immensely very hardpressed to convince a go-between that he left unpaid merchandise within a truck instead of a warehouse.
