Me and my husband have been surrounded by chapter 13 bankruptcy for 3 1/2 years now. We run a little behind on our second months payment and talked to our advocate and was told we could do a partial chapter 13 discharge. We can get out of ruin with 75% of our debt paid and are free to step. How much will this affect out credit by getting out now vs. sticking it out the rest of the 9 months with100% paid??

Thats right. It doesnt matter. Its not going to hurt you. You already own a BKC on your credit report.

So if your attorney thinks he can get you a partial than instruct him to kind his attempt.

Chances are not that great but you got nothing to lose.

I've never deal with partial discharges.they are quite difficult to achieve, so be grateful if you can convince the court to allow it.

But I don't really think it's going to effect you at all. Reporting of collapse is 10 years from the date filed. So an early discharge does not return with it removed any sooner.

And from a credit point of view, a bankruptcy is a collapse...there are no "good" flavors to it.
