Helpppppp...Can anyone tell me what steps is taken after a doomed to failure check is written...due to the fact I close a report 5 months ago thinking ever thing be taken care of...but immediately I get a nickname from a collection agency stating I had 5 days to transport the cash or he is turning over to the magistrate department..will i be put in send to prison ASAP if i cant come up with the dosh in 5 days..support
If you were contacted by a collection agency in connection with the bad check, they be probably just trying to startle you into paying the debt off. If a collection agency is holding the debt, it funds that they acquired it from your wall or whomever you wrote the check to. I don't believe that they can, rightfully, have you prosecuted for such a debt, since it wasn't originally written to them.

If ,for some principle, they can, you will have your sunshine in court. You won't newly be put in detention centre. You'll be summons to court and will be asked to pled. Tell the judge that you made a mistake within your ledger and didn't purposely mean for the check to bounce. If this is your first time, you'll more than possible just own to pay the check past its sell-by date, along with court costs and fines. If you don't enjoy the money to pay these things sour at the time, you can usually work out a payment plan near the court.

Don't worry so much. I'd place bets that the collection agency is freshly trying to collect from you to make a profit on the purchase of the debt. In count, if you do some online research, you will find that post dated checks (those written at payday loan businesses) can't be prosecuted because the payday loan businesses are fully aware at the time that they are written that they are bad.
